By accessing or using FlyByTheWay (flybytheway.com) and its services, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Service Description
FlyByTheWay is an aviation intelligence and flight booking platform providing flight search, booking facilitation, pre-booking compliance checks (Beast Engine), and AI-assisted travel advisory (VIDHUR). We act as a facilitating agent and not as a carrier.
2. Eligibility
- You must be at least 18 years of age to make a booking.
- You must have legal authority to agree to these Terms on behalf of all passengers named in a booking.
- Bookings made using false identity are void and may be reported to relevant authorities.
3. Booking & Ticketing
- All bookings are subject to airline fare rules, availability, and applicable government regulations.
- Tickets are issued subject to IATA BSP India settlement rules and applicable GST.
- FlyByTheWay is not responsible for fare increases between search and booking due to real-time pricing.
- Your booking is confirmed only upon receipt of a booking reference and e-ticket/itinerary.
4. User Obligations
- You must provide accurate passenger names exactly as per the travel document (passport/national ID).
- Passport validity must meet the destination and transit country requirements. Beast Engine checks this — you remain responsible for compliance.
- You must hold all required visas, transit visas, and travel documents before travel.
- FlyByTheWay shall not be liable for denied boarding due to documentation failure.
5. Intellectual Property
Beast Engine, VIDHUR, FlyBrain, HAMAYA, and all platform intelligence systems are proprietary to FlyByTheWay Travel Management. Unauthorised use, scraping, or reproduction is prohibited.
6. Limitation of Liability
FlyByTheWay acts as an agent between passengers and airlines. We are not liable for airline operational failures, cancellations, delays, or INAD events. Our liability is limited to the service fee paid, if any.
7. Governing Law
These Terms are governed by the laws of India. Disputes are subject to the jurisdiction of courts in Aligarh, Uttar Pradesh.
